Democrats tried to damage Judge Brett Kavanaugh’s trustworthiness on Thursday, and obstruct his confirmation to the U.S. Supreme Court, by questioning why he would not join them in demanding that the Federal Bureau or Investigation (FBI) carry out an allegedly “nonpartisan” and “independent” questions into Christine Blasey Ford’s current claim that he searched her in high school, over 35 years ago.It was the one efficient point of attack– and the one concern on which Kavanaugh looked rather weak. He said in his stirring opening statement– which will go into the history books as one of the great minutes in American oratory– that he invited an FBI investigation.Yet Democrats ignored that and pressed forward as if he had never ever said that

. The execrable Sen Penis Durbin(D-IL)required, finger wagging and all, that Kavanaugh inform White Home Counsel Don McGahn to stop the confirmation process– as if the president controls the Senate, and the judge controls the president– until the FBI might investigate.Kavanaugh was repeatedly required to defend the Senate Judiciary Committee’s choice as if it were his own. It fell to Sen. Lindsey Graham(R-SC)to mention, in his similarly remarkable< a href=https://www.breitbart.com/big-government/2018/09/27/lindsey-graham-blasts-dianne-feinstein-this-is-the-most-unethical-sham-since-ive-been-in-politics/ > speech, that committee Democrats could have approached Republicans to demand an FBI examination when they initially found out about Dr. Ford’s claims in July, however instead picked to hold them in reserve and leak them later, damaging both the accuser and the accused.Still, why not now? Kavanaugh tried to explain that the FBI would not, and could not, tell the committee more than it currently understood. He kept in mind that every possible witness had actually currently sent declarations under oath, all contradicting Dr. Ford’s claims; that the FBI does not reach conclusions or make recommendations when it examines judicial candidates; and that the 10 days’delay between his ask for a hearing to clear his name– a hold-up partly triggered, he may have added, by Dr. Ford’s lawyers deceptive the committee about her fear of flying– had actually been worse than hell for him and his family.Committee chair Sen. Chuck Grassley(R-IA)also priced quote then-Sen. Joe Biden(D-DE)– twice– telling the committee during the Clarence Thomas hearings in 1991 that the FBI’s evaluation was useless as a determination of the realities which it was up to the committee to get to its own conclusions.Yet Dr. Ford’s refusal to sign up with Democrats in calling for another investigation made it look, at least to those inclined to disbelieve him, as though he had something to hide. And he did– though it was nothing to be ashamed of: Kavanaugh was”hiding “the truth that he desires the job.He also knows complete well that every hour of hold-up minimizes his chances of success, due to the fact that the Michael Avenattis of the world have instantaneous access to cable television news studios; since if Democrats can push a vote off until after the midterm elections, they may delay it forever; and because the moderate Republicans in whose hands his fate rests are usually too afraid to stand up to continual pressure.Perhaps Kavanaugh also believes that no investigation will be enough for Democrats who think fart jokes in high school yearbooks relate to determining his trustworthiness.(They did not ask Dr. Ford about her yearbooks.)There is something even more absurd about including the FBI at this stage of the confirmation process, and it was not pointed out by anybody in the hearing room on Thursday. Particularly: the concept that the FBI might be thought about”non-partisan”or

“independent”is a joke after all we have found out about its role in the 2016 presidential election.Yes, a few of the bad apples are gone. It is far too soon for Americans to feel comfortable about the company’s stability. Any conclusion– even one that supported Kavanaugh– would quickly be viewed as an outcome of partisan bias. That is why FBI Director Christopher Wray has wisely sought to keep his agency out of this specific fight. Moreover, while the FBI does supply information on judicial candidates to the White Home and Senate, asking it to intervene at this late phase is the exact same as asking it to determine the outcome. That breaches the separation of powers by outsourcing the Senate’s constitutional obligation to the executive branch and law enforcement.More than 2 years earlier, the FBI tossed an election, and the nation, into turmoil. We have been through, the fact that Democrats still want the FBI to make major political decisions is beyond absurd. It is frightening.Joel B. Pollak is Senior Editor-at-Large at Breitbart News. He
